FRAUD ALERT!!!

We ordered a custom designer couch (Robert Michael brand) from Consumer's Furniture that was supposed to be ready in 4-6 weeks. Unfortunately, we paid the full amount $2875.42 up front trusting them to be ethical. They called at about 5 weeks and said the fabric was on back order...we would have to wait another 4-6 weeks. Then about another 6 weeks later they called to tell us that the manufacture went out of business and we would need to choose a different couch. We went back in and looked around...we don't want anything else instead and since they can't possibly get us the couch we ordered (Robert Michael brand), we didn't expect they wouldn't give us our money back. Scott, the manager said he will only give us a store credit (and he will not allow us to speak with the owner) even though he can NOT get the item we ordered. Although Scott did tell us he spoke with the owner about the situation and the owner of Consumers Furniture also said "NO" to giving us our money back! So apparently the family that owns Consumer's Furniture knows about it and doesn't care either! The manager Scott has NOT been consoling at all through this process and just keeps saying, "We're not going to give you your money back!" It seems so cut and dry to me... the maker of the couch we ordered went out of business. We can't get our "Robert Michael" brand couch. please give us our money back, thank you. Easy peasy right? NOPE! They're holding our almost $3000.00 hostage!! They can NOT get us what we ordered, we just want our money back. No harm no foul. I mean come on Consumer's family.. Really?? Wow! Totally ludicrous. We will try to get a refund from our credit card first and will prevail in to court if needed, but making us fight for a refund is not the right way to do business. We have a written contract and they did not and can NOT fulfill our order, they should DO THE RIGHT THING and refund our payment. This is legally "breach of contract". We will prevail eventually but save yourself a potential headache and a hassle!! I will bring my business elsewhere.
